Terms of Service
By using this website or engaging Athena Towing LLC ("Athena Towing", "we", "us", "our") for any service — towing, roadside assistance, impound, vehicle storage, used vehicle sales or rentals, or any other service we offer — you ("you", "Customer") agree to these Terms of Service ("Terms"). If you don't agree to these Terms, don't use our services.
Before we send a driver, we text you a link to this page. By replying YES to that text (or by verbally confirming with a dispatcher on a recorded line), you agree to all three of the following:
- Service authorization. You authorize Athena Towing to dispatch a driver and to perform the requested service on the vehicle, on the terms set out below. If you are not the registered owner, you represent that you have the owner's permission to authorize this service.
- SMS notifications. You consent to receive transactional SMS from us related to this service — including dispatch confirmation, driver ETA, on-scene arrival, completion, and any necessary follow-up. Message and data rates apply. Reply
STOPat any time to opt out (opting out after dispatch may delay status updates). ReplyHELPfor help. - Invoice by text. You consent to receive your invoice and payment receipt by SMS (containing a link to view, download, and pay) in addition to or instead of by email.
If you do not consent, we cannot dispatch a driver. Consent to SMS is only for service messages tied to your request — it is not consent to marketing texts, which would require a separate opt-in.
Services We Offer
Athena Towing LLC provides:
- 24/7 towing for light and medium-duty vehicles (passenger cars, SUVs, pickups, vans, box trucks, small/medium RVs, motorcycles, small 5th-wheel and gooseneck trailers, boats up to posted weight limits)
- Roadside assistance (jump starts, lockouts, tire changes, mobile tire service, tire repair, fuel and diesel delivery, battery service, lug nut removal)
- Impound and on-property removal services for property owners, businesses, apartment communities, HOAs, and law enforcement
- Secure outdoor vehicle storage at our Athens, GA lot
- Used vehicle sales and rentals (governed by a separate purchase or rental agreement at the point of sale or rental)
We do not currently offer heavy-duty (Class 7+) towing such as semi tractors, dump trucks, buses, or tankers. We're happy to refer you to a qualified partner for those jobs.
Service Area
Our primary service area is Athens, GA and surrounding communities — including Watkinsville, Bogart, Winterville, Hull, Arnoldsville, Lexington, and Attica. Long-distance tows are available throughout Georgia and into neighboring states by quote.
Pricing and Payment
We quote your job in full before dispatching. The quoted price is the price you pay unless the job changes materially in scope — for example, additional time, additional services you request, or significant on-site discovery (concealed damage, hazardous conditions, etc.). If anything changes mid-job, we'll tell you immediately and you decide whether to proceed.
Accepted payment methods: credit and debit cards, Apple Pay, Google Pay, and cash. Payment is due on completion of service unless other arrangements have been agreed in advance (insurance billing, fleet account, written net-terms agreement).
Vehicle storage: $40/month per 9x20 standard parking spot, billed monthly in advance. Larger vehicles or specialty storage are quoted on request. Daily storage charges apply to impounded and unretrieved vehicles per our posted rate schedule.
Additional charges that may apply beyond the base quote include: Gone-On-Arrival fees (see below), winch-out / off-road extraction, additional time waiting on customer or law enforcement at the scene, extra equipment (dollies, tarps, skates), hazmat or scene-cleanup labor, after-hours premium where applicable, mileage beyond the quoted distance, and any government or third-party fees we have to pay on your behalf. We disclose any such surcharge before incurring it whenever possible.
Estimated Response Times
We aim for arrival within approximately 30 minutes in the immediate Athens area. Actual response time depends on truck availability, traffic, weather, time of day, and current call volume. ETAs are estimates, not guarantees. For life-threatening emergencies, call 911 first.
Damage-Free Towing and Documentation
We use flatbed transport whenever appropriate to protect drivetrains, AWD/4WD systems, EVs, and lowered vehicles. We may photograph and document the vehicle's condition before, during, and after the tow — both to record pre-existing damage and to protect both parties in the event of a later claim.
Your Responsibilities as Customer
By requesting service, you represent and agree that you will:
- Provide accurate location and vehicle information
- Have the legal authority to authorize service on the vehicle (if you are not the registered owner, you confirm you have the owner's permission)
- Disclose known hazards: fluid leaks, structural damage, alternative fuels, custom modifications, or any condition that affects safe handling
- Remove or secure personal belongings from the vehicle before tow — we are not responsible for items left inside
- Pay the agreed charges promptly upon completion
Limitation of Liability
To the maximum extent permitted by Georgia law:
- Our total liability for any single incident is limited to the amount you paid us for the specific service in question.
- We are not liable for pre-existing damage, damage caused by mechanical failure unrelated to our handling, weather damage to stored vehicles, theft or damage to personal property left inside vehicles, or any consequential, incidental, special, or punitive damages.
- We carry commercial insurance for the work we do. Customers should maintain their own auto insurance covering theft, vandalism, fire, weather, collision, and other risks — especially for vehicles held in storage.
Right to Refuse Service
We reserve the right to refuse, suspend, or terminate service when:
- The customer or any party at the scene is intoxicated, aggressive, or threatening
- The scene is unsafe and cannot be made safe (active traffic with no shoulder, fire, hazmat spill, structural collapse) — we'll call appropriate emergency services
- The vehicle exceeds our equipment capabilities — we'll refer you to a qualified partner
- Payment cannot be reasonably assured
- The job is illegal or would require us to violate applicable law
Cancellations, No-Shows, and Gone-On-Arrival (GOA)
Once a driver has been dispatched for you, our truck is committed to your call and unavailable to take another. We try to be reasonable about cancellations, but we have to be paid for time and miles already spent.
- Before dispatch: Cancel for any reason at no charge — just call us.
- 15-minute grace period after dispatch: If you call to cancel within 15 minutes of dispatch, no charge applies.
- After 15 minutes, or no notification (GOA / no-show): A Gone-On-Arrival fee of $35 plus $4 per mile applies, based on the miles the driver had already driven from the dispatch origin toward your reported location at the point the cancellation or GOA was determined. Example: if the driver had driven 12 miles toward you, the fee is $35 + (12 × $4) = $83.
- On-scene decline or "false start": If our truck arrives and you refuse service, the vehicle or location isn't as described, the vehicle keys aren't available, or the situation can't be safely handled with the dispatched equipment, the full quoted service charge applies in lieu of the GOA fee.
- False or fraudulent call: If a caller authorizes a tow without authority to do so (e.g., not the owner and without the owner's permission), the caller is personally responsible for the GOA fee or full service charge, as applicable, plus any costs we incur to release or return the vehicle.
GOA fees and on-scene declines may be charged to a card you pre-authorized at the time of dispatch, billed to your insurance if insurance billing was set up, or invoiced for payment within 7 days.
Wait Time and On-Scene Labor
The quoted tow rate includes loading, transport, and unloading under normal conditions: customer present (or keys left where we agreed), vehicle accessible, and no unusual obstacles. If we have to wait or perform extra labor on scene, additional labor charges apply.
- 15-minute on-scene grace period at no charge after our driver arrives and is ready to load. Use this to grab your wallet, snap a last photo, get the kids out of the back seat — whatever.
- After 15 minutes we bill labor at $60/hour ($15 per 15-minute increment), billed in 15-minute increments. This applies whenever a driver is held on scene by something outside our control, including but not limited to:
- You are not with the vehicle and we are waiting for you to arrive
- You're present but not ready to release the vehicle
- You are waiting on a third party (insurance adjuster, law enforcement, locksmith, mechanic, family member, etc.) before authorizing the tow
- You need additional time to remove personal property from the vehicle
- Keys not available: if the keys are not in the vehicle or surrendered when we arrive (and we have to wait, drill a lock, retrieve a spare, or take other steps to load), the grace period does not apply — the labor clock starts the moment we arrive and are blocked from loading. Lock-out / key-retrieval procedures, where requested, are billed separately under our roadside-assistance rates in addition to wait time.
- Customer not present and unreachable: if you are not on scene and we cannot reach you within a reasonable attempt (typically one call and one text, with the GOA clock running), we treat it as a GOA (see above) instead of wait time.
If you know in advance that wait time will be required (you're meeting the truck at the scene from elsewhere, the keys are with a roommate, etc.), tell dispatch so we can plan accordingly and avoid surprise charges.
Vehicle Inspection and Pre-Existing Damage
Our driver will perform a visible walk-around of the vehicle before loading and document any pre-existing damage (photos, written notes, or both). You have the right to review and confirm this inspection at the scene. We are not responsible for damage that existed before we touched the vehicle, and we are not responsible for cosmetic items (paint chips, minor scrapes, etc.) that are not noted at intake but are claimed afterward without supporting evidence.
Hidden, Latent, and Consequential Damage
Towing is a mechanical process performed on equipment we did not design, build, or maintain. Even when handled correctly, towing can sometimes reveal or aggravate pre-existing weakness (worn ball joints, stressed brackets, deteriorated bushings, rusted fasteners, etc.). We are not responsible for damage caused by such pre-existing conditions, by mechanical failure unrelated to our handling, by the customer's failure to disclose known issues, or by hidden defects we could not reasonably have discovered during a normal inspection.
Keys, Wheel Locks, and Special Vehicle Conditions
You are responsible for providing functional keys (or proof of authority to handle without them), wheel-lock keys if your wheels have them, and any unusual handling instructions. If keys or wheel-lock keys are unavailable and additional time, equipment, or destruction of a wheel lock is required, additional charges may apply at our posted rates and will be itemized on the invoice. See also Wait Time and On-Scene Labor.
For electric vehicles, hybrids, or alternative-fuel vehicles (Tesla, Rivian, Lucid, Lightning, CNG, propane, etc.), notify dispatch when you call. These vehicles require specific procedures (flatbed only for most EVs; battery-disconnect or fuel-shutoff for some alternative fuels). If we arrive and the vehicle type was not disclosed and requires different equipment, the GOA fee or a re-dispatch fee may apply.
Drop-Off and Customer Acceptance
You are responsible for ensuring the drop-off location accepts the vehicle (open, staffed, with adequate space). If the destination refuses delivery or no one is available to accept the vehicle, we will attempt to reach you for instructions; if we cannot, the vehicle will be returned to our Athens lot and storage charges will apply from that point.
Insurance Billing and Subrogation
If you request that we bill your insurance carrier directly, you authorize us to communicate with the carrier and submit invoices on your behalf. You remain personally responsible for any portion the insurance carrier does not pay (deductible, denied charges, balance after policy limits, etc.). To the extent permitted by your policy, you assign to Athena Towing the right to recover towing and related charges directly from at-fault parties or their insurers; this does not increase your liability beyond what is already set out in these Terms.
Returned Payments and Collections
Invoices are due on completion of service unless other arrangements are in writing. For balances that remain unpaid:
- A $35 returned-payment fee applies to any check, ACH, or card chargeback that fails for any reason other than our error.
- You agree to pay reasonable costs of collection, including collection-agency fees and reasonable attorneys' fees, where permitted by law.
For impounded and stored vehicles, unpaid balances may also result in a lien sale of the vehicle under Georgia law (see Impound and Lien Rights below).
Weather, Safety, and Force Majeure
We may delay or suspend service when conditions make it unsafe for our drivers, your vehicle, or the public — for example, severe storms, lightning, flooding, fire, hazmat, civil unrest, or law-enforcement closure of the scene. We are not liable for delays or non-performance caused by events outside our reasonable control, including acts of God, government action, labor disruption, equipment failure not caused by our negligence, or communications outages.
Impound and Lien Rights
Vehicles towed at the request of a property owner, business, or law enforcement and stored at our lot accrue daily storage charges from the date of tow. Under Georgia law (including O.C.G.A. § 40-11-1 et seq. and related statutes), abandoned vehicles may be sold at lien sale after the required statutory notice and waiting period to recover towing and storage costs.
Vehicle release requires valid government-issued photo ID, proof of ownership or written authorization, and payment in full of all accrued charges. See our Impound page for full release procedures.
Vehicle Storage
Voluntary storage customers retain ownership of their vehicles and are responsible for:
- Maintaining their own insurance covering theft, vandalism, fire, weather, and other risks while in storage
- Paying monthly storage charges in advance
- Providing reasonable advance notice for retrieval requests
We provide commercially reasonable security — barbed-wire perimeter fencing, 24/7 monitored security cameras, floodlights, and active dispatch presence — but we do not insure stored vehicles and are not liable for theft or damage caused by third parties or by acts of nature. See our Vehicle Storage page for current rates and additional terms.
If a vehicle remains in storage beyond an agreed term without payment, we may treat it as abandoned and follow the same lien process described above for impounded vehicles.
Used Vehicle Sales and Rentals
Vehicles sold or rented under our used-cars-and-rentals service are subject to a separate purchase agreement or rental agreement provided at the point of sale or rental. Those agreements govern the specific transaction and supersede these general Terms with respect to that transaction.
Communications, Recordings, and Photos
By engaging us for service, you consent to receive calls and SMS messages from us related to that service (see the Consent block at the top of this section for the full text), and to receive your invoice and payment receipt by SMS. Standard message and data rates apply. Reply STOP to opt out of texts. Consent to service messaging is a condition of dispatch; consent to marketing messaging is separate and never required.
We may record phone calls for training, quality assurance, and dispute resolution. By calling us, you consent to such recording. We may also take photos and video at the scene, during loading, in transit, and at our lot — both to document the vehicle's condition for everyone's protection and for internal training and dispute resolution. These photos and recordings remain our property.
Indemnification
You agree to indemnify, defend, and hold harmless Athena Towing LLC, its members, employees, drivers, and contractors from any third-party claims, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your misrepresentation of authority to authorize service on a vehicle
- Your failure to disclose known hazards or material damage
- Your wrongful refusal to pay agreed charges
- Property of a third party left in or with the vehicle
Dispute Resolution
We always try to resolve any issue with you directly. If something goes wrong, call us at (706) 810-6046 or email info@athenatowing.com — we'd much rather fix it than fight about it.
If a dispute can't be resolved informally, both parties agree to attempt good-faith negotiation before pursuing other remedies. Any unresolved dispute is governed by the laws of the State of Georgia (without regard to its conflict-of-laws rules) and will be litigated exclusively in the state or federal courts located in Clarke County, Georgia.
Modifications
We may update these Terms from time to time. The current version is always available on this page, and we'll update the "Last updated" date at the top whenever changes are posted. Your continued use of the Service or our services after a change constitutes acceptance of the updated Terms.
Severability and Waiver
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision on any given occasion is not a waiver of that provision in any future occasion.
Entire Agreement
These Terms, together with our Privacy Policy (above), any quote or estimate we provide for a specific job, and any separate written agreement we sign with you (for example, a fleet account agreement, vehicle rental agreement, or property-owner standing-tow agreement), constitute the entire agreement between you and Athena Towing LLC for the services described. They supersede any prior oral statements, advertisements, or website content that conflicts with them. No statement by a driver, dispatcher, or other employee can modify these Terms unless we confirm it in writing.
